사기죄 성립요건

윤태중 변호사가 말하는 사기사건의 성립 조건

 

역시 제대로 배운 사람이라 제대로 말 하는군요

사기죄 성립은 사람을 기망해서 재물의 교부를 받거나 재산상의 이익을 취득함으로써 

성립하는 범죄입니다

 

사기죄 성립요건은 

범죄의 구성요건에 해당하는지, 위법성을 조각하지 않았는지, 책임을 조각하지 않았는지

 

한국 말이 어려우니 미국식으로 풀이 하여 다시 말하면 

계획적(장기적, 단기적) 인지, 위법성이 있는지, 책임질 일이 였는지,

 

사람을 기망해서 재물의 교부를 받거나 재산상의 이익을 취득한 사람은 

10년 이하의 징역및 2천만원 이하의 벌금에 처하게 됩니다.

 

기망의 뜻은 

남을 그럴듯이 "속인다" 입니다.
